Clothing & Beyond operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Clothing & Beyond is powered by Shopify, which enables us to provide the Services to you.
This Privacy Policy describes how we collect, use, hold and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services, or otherwise communicate with us. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), and, for customers in New Zealand, the Privacy Act 2020 (NZ) and the Information Privacy Principles.
If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing and disclosure of your personal information.

Personal Information We Collect or Process
When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you.
We may collect or process the following categories of personal information, including inferences drawn from this information, depending on how you interact with the Services and as permitted or required by applicable law:
- Contact details including your name, address, billing address, shipping address, phone number and email address.
- Financial information including payment card information, financial account information, transaction details, form of payment and payment confirmation. We do not store full card numbers ourselves — these are handled directly by our payment processors.

- Transaction information including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel, and your past transactions.
- Communications with us including the information you include in communications with us, for example when sending a customer support enquiry.

- From our advertising and analytics partners, including Google and Meta, where they report on the performance of our advertising.
You can browse our website without giving us your name. However, we cannot process an order, arrange delivery or answer a support enquiry without contact and delivery details.
Cookies and Similar Tracking Technologies
We use cookies, pixels, tags, software development kits (SDKs), local storage and similar technologies on our website. A cookie is a small text file placed on your device that allows a website or a third party to recognise your browser across visits.
We use these technologies in the following broad categories.
Strictly necessary. These are required for the website to work. They keep your cart contents, keep you signed in, route your session, process checkout and protect against fraud and abuse. These are set primarily by Shopify and by our payment processors. The Services will not function correctly without them.
Performance and analytics. These help us understand how visitors find and use our website — which pages are viewed, how long people stay, where they drop off, and which products are viewed most — so that we can improve the Services. We use Shopify's built-in analytics for this purpose, and we may also use Google Analytics.
Advertising and remarketing. These allow us to measure the performance of our advertising and to show you advertisements for our products on other websites, apps and platforms after you have visited our website. We advertise on Google and on Meta's platforms, and we use the tracking technologies described below.
We use Google Ads conversion tracking, Google Ads remarketing and Google Merchant Center (including the Google & YouTube app for Shopify), implemented through the Google tag and Google Tag Manager. We may also use Google Analytics to measure website performance.
These technologies allow us to:
- measure which advertisements, keywords and campaigns lead to a purchase, an added payment method, or another action on our website;
- build remarketing audiences so that our advertisements can be shown to people who have previously visited our website or viewed particular products, across Google Search, YouTube, Gmail, Google Display Network and Google Shopping;
- report on aggregate website performance and audience characteristics.
Where enhanced conversion measurement is enabled, information you provide at checkout — such as your email address — may be converted into an irreversible hashed value on your device before being sent to Google, so that a conversion can be matched to an advertisement click without disclosing your details in readable form.

Meta (Facebook and Instagram)
We use the Meta Pixel, together with Meta's advertising tools for Custom Audiences and Advantage+ campaigns. We may also use the Meta Conversions API, which sends comparable event information from Shopify's servers directly to Meta rather than from your browser.
These technologies allow us to:
- measure which advertisements on Facebook and Instagram lead to a purchase or another action on our website;
- build Custom Audiences so that our advertisements can be shown to people who have previously visited our website, viewed particular products, or added items to their cart;
- build Lookalike Audiences based on characteristics shared with our existing customers and website visitors.
In each case, identifying information such as your email address or phone number is hashed before it is transmitted. Meta acts as an independent controller of the information it receives and processes it as described at https://www.facebook.com/privacy/policy.
Managing cookies and advertising preferences
You have a number of options:
- Browser settings. Most browsers let you refuse or delete cookies, or notify you when a cookie is set. Blocking strictly necessary cookies will prevent checkout from working.
- Google. You can manage the advertisements you see and turn off ad personalisation at https://adssettings.google.com. Where Google Analytics is in use, you can opt out of measurement using the browser add-on at https://tools.google.com/dlpage/gaoptout.
- Meta. You can manage ad preferences and see why you were shown a particular advertisement in the Ad Preferences section of your Facebook or Instagram account settings.
- Industry opt-outs. Australian residents can manage interest-based advertising from participating companies at https://www.youronlinechoices.com.au. New Zealand residents can use https://www.youronlinechoices.com/nz.
- Device settings. Mobile operating systems allow you to reset or limit your advertising identifier.
Opting out will not reduce the number of advertisements you see — it means the advertisements you see are less likely to be relevant to you.
How We Use Your Personal Information
Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:
Provide, tailor and improve the Services. To perform our contract with you, process your payments, fulfil your orders, remember your preferences and items you are interested in, send notifications related to your account, process purchases, returns, exchanges or other transactions, create and manage your account, arrange shipping, facilitate returns and exchanges, enable you to post reviews, and create a customised shopping experience such as recommending related products.
Marketing and advertising. To send marketing, advertising and promotional communications by email, text message or post, and to show you online advertisements for our products on other websites and platforms, including based on items you previously purchased or added to your cart and other activity on the Services. Where required, we will only send you direct marketing with your consent or where you would reasonably expect it, and every marketing message includes an unsubscribe function, consistent with the Spam Act 2003 (Cth) and the Unsolicited Electronic Messages Act 2007 (NZ).
Security and fraud prevention. To authenticate your account, provide a secure payment and shopping experience, and detect, investigate or take action regarding possible fraudulent, illegal, unsafe or malicious activity. If you register an account, you are responsible for keeping your credentials safe. We recommend you do not share your username, password or other access details with anyone.
Communicating with you. To provide customer support, respond to your enquiries, and maintain our business relationship with you.
Legal reasons. To comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, to participate in civil discovery, potential or actual litigation or other legal proceedings, and to enforce or investigate potential breaches of our terms or policies.
How We Disclose Personal Information
In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. These include:
- Shopify, which hosts the Services and processes personal information about your access to and use of the Services.
- Payment processors, which handle card and other payment details directly.
- Suppliers, warehouses and shipping carriers, which receive the name, delivery address, contact details and order contents needed to pack and deliver your order.
- Vendors and other service providers performing services on our behalf, such as IT management, data analytics, customer support and cloud storage.

Relationship with Shopify
The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify, as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you.
In addition, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over the use of your personal information for these purposes. Overseas Disclosure
We are based in Australia, and we may store, transfer or process your personal information outside the country you live in.
Recipients of your personal information are likely to be located in Canada and the United States (Shopify, Google, Meta and cloud hosting providers), and in China and other countries where our suppliers and fulfilment partners are located.
Before disclosing personal information overseas, we take reasonable steps in the circumstances to ensure the recipient handles it in a way consistent with the Australian Privacy Principles, as required by APP 8, including through our contractual arrangements with those parties. You should be aware that these countries may not have privacy laws equivalent to Australia's or New Zealand's, and that we may not be able to control how your information is handled once it is disclosed.

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness or reliability of information found on them.
Information you provide on public or semi-public venues, including information you share on third-party social networking platforms, may also be viewable by other users of the Services and of those platforms. Our inclusion of such links does not, by itself, imply any endorsement of the content on those platforms or of their owners or operators, except as disclosed on the Services.
Children's Data
The Services are not intended to be used by children, and we do not knowingly collect personal information from children. Where our products are purchased for children, we expect the purchase to be made by a parent or guardian. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the details below to request that it be deleted.
Security and Retention of Your Information
